Colorado landlord “accidentally” double-charges rent via tenant’s ACH, then refuses to refund it, and tries keeping it as “account credit” until after move-out

  • For this month, my apartment management mistakenly processed my rent payment twice. Because I have automatic
  • ACH payments set up, the money was withdrawn from my bank account automatically.
  • I immediately contacted management and filed an official Service Request in the tenant
  • portal to establish a paper trail. Yesterday, I noticed they marked the Service Request as "Completed," but no money returned to my bank account.
  • When I checked the payment portal, I discovered they applied the refund as an "account credit."

  • I spoke with them this morning, and they claim they cannot refund the money directly to my bank or issue a manual check
  • right now. They told me that normally it would just go toward next month's rent. However, I am moving out at the end of this
  • month. Because of this, they said they will just issue a check for the overpayment along with my security deposit after I move.
  • Per my lease, they may take up to 30 days after I move out to return the security deposit. This means I will likely be locked out
  • of a significant amount of my own cash for up to two months due to a clerical error that was entirely their fault. I desperately
  • need this money right now to cover my upcoming moving expenses. My questions are:
  • 1. Can they legally hold this money as an "account credit"? I never authorized this second payment, and since my lease is ending, a "credit" is useless to me.
  • 2. Can I initiate an ACH reversal with my bank one week after the payment posted? Will the bank count a duplicate automated charge as an unauthorized transaction?
  • 3. Should I escalate this to the regional/corporate office of the investment group that owns the property?
  • What are my best options for forcing them to return my money immediately? Any advice is appreciated!
  • overkillsd Contact your bank and ask them for advice. Tell them. that the duplicate ACH was not authorized, and the other party is refusing to return your funds.

  • RudessJordan72 OP Update: Talked to my bank just now. Filed a dispute and they initiated a ACH reversal for the extra charge.
